General Terms
Let’s Explore Limited (Let’s Explore) is a company incorporated in New Zealand. These Terms of Service (“Agreement”) govern your use of the website services provided by Let’s Explore, including web design and creative services, referral and recommendation, maintenance service, device-specific technical support, web hosting and security, email services, and payments (collectively, the “Services”). By using the Services, you agree to be bound by this Agreement, as well as Let’s Explore’s Privacy Policy.
1.1 Eligibility: You must be at least 18 years old, or a corporation capable of entering into legally binding agreements to use the Services.
1.2 Modification: Let’s Explore may modify this Agreement from time to time, and such modifications will be effective upon posting on the Let’s Explore website.
1.3 Ownership: During development, Let’s Explore owns all right, title, and interest in and to the Services, including all intellectual property rights until payment has been received in full.
1.4 Termination: Let’s Explore may terminate this Agreement and your access to the Services at any time, with or without cause, by providing notice to you. Upon termination, you must immediately cease using the Services.
Web Design & Creative Services
2.1 Scoping Phase: Let’s Explore will prepare a detailed scope of works statement based on the brief provided by the client. Future variations may involve additional fees and extensions to time.
2.2 Recommendations: Let’s Explore may advise or recommend other service providers if unable to deliver on the required scope of works.
2.3 Timing: Let’s Explore will provide indicative timing of project delivery within a project proposal, subject to change if there are delays in the provision of dependencies such as content and other creative elements required.
2.4 Placeholder Content: If there is a delay in the client providing content or creative elements, Let’s Explore reserves the right to insert placeholder content and images to complete the project, and invoice for the balance of project fees.
2.5 Plagiarised Content: Let’s Explore takes no responsibility if content or images provided by the client are plagiarised or copied from other sources without authorisation.
Referral & Recommendation
3.1 Liability: Let’s Explore cannot be held liable for any failure of a third party to deliver service.
3.2 Fees: Let’s Explore may charge an hourly fee if there is substantial coordination required.
Maintenance Services
4.1 Support: Let’s Explore offers web hosting services with technical support available. Full management services include an allowance for updates and changes. Any maintenance outside the scope of included support will be charged at an hourly rate.
4.2 Estimate: It is the client’s responsibility to request an estimate in advance if required before maintenance work is undertaken.
Device-Specific Technical Support
4.3 Limitations: Web Hosting and Email service support is limited to resolving issues with the server and infrastructure. Device-specific support will incur an hourly service charge.
Web Hosting & Security
4.4 Servers: Websites hosted by Let’s Explore are hosted on Australian servers in secure data centres located in Sydney, New South Wales.
4.5 Technical Support: Website-specific technical support is available during business hours via support@letsexplore.nz. The target response time for a technical support request is 24 to 48 hours, during normal business days.
4.6 Backups: Backups are automated on an hourly or daily basis, depending on the service agreement in place. Let’s Explore will not be held liable for data loss in the event of a backup failure. Let’s Explore will not be liable for any business interruption due to service interruptions while services are being restored.
4.7 Malicious Activity: Let’s Explore uses several layers of protection to prevent malicious activity on your website. Let’s Explore is not liable for any failure of these protections.
4.8 Client Copy of Files: On request, Let’s Explore can provide a full backup copy of website files for the client to store. It is the client’s responsibility to request and store this backup securely.
Email Services
5.1 Mailbox Capacity: If capacity is reached then received messages may bounce to the sender if the mailbox is full.
5.2 Cloud Providers: If emails are connected with a cloud provider, any technical issues will be the responsibility of the cloud provider, and Let’s Explore may charge an hourly fee for assistance in diagnosing and communicating the issue with the provider.
5.3 Payment: It is the client’s responsibility to ensure that the cloud email provider payment account is kept current and fully paid up at all times to avoid disruption.
5.4 Non-Delivery: Let’s Explore will not be held liable for non-delivery of notifications such as website enquiries, and it is the client’s responsibility to regularly check website forms and contact Let’s Explore for assistance in providing a workaround solution if needed.
5.5 Email Outage: Let’s Explore will not be liable for any business interruption due to service interruptions while services are being restored.
Privacy Policy
Let’s Explore is committed to protecting your privacy and is bound by the Privacy Act 1988 (Crh), which sets out a number of principles concerning the privacy of individuals.
Collection of Personal Information
6.1 Let’s Explore may collect personal information, such as name, email address, and phone number when you use our Services. We may also collect information from third parties, such as social media platforms, if you choose to link your account with Let’s Explore.
6.2 We use this information to provide the Services, communicate with you, and improve the Services.
Sharing of Personal Information
6.3 Let’s Explore will not sell, rent, or lease your personal information to third parties.
6.4 We may share your personal information with third parties who provide services to Let’s Explore, such as payment processors and marketing service providers. These third parties are required to keep your personal information confidential and are not allowed to use it for any other purpose.
6.5 We may also disclose your personal information if required by law or to protect the rights, property, or safety of Let’s Explore, its users, or others.

6.6 Let’s Explore may use your personal information to provide the Services, communicate with you, and improve the Services.
6.7 We may also use your personal information for marketing purposes, such as sending you promotional emails or newsletters. You can opt out of receiving these communications at any time.

Payment Terms
7.1 The client agrees to pay Let’s Explore for the Services provided in accordance with the pricing and payment terms outlined in the project proposal or service agreement.
7.2 Payment is due by the due date on the invoice unless otherwise stated in the project proposal or service agreement.
7.3 If payments are not received by the due date, Let’s Explore reserves the right to suspend services without further notice.
7.4 Files will be retained for 12 months, and a fee may be charged for the restoration of services that require reinstallation from backup.
7.5 Let’s Explore reserves the right to charge interest on any outstanding balance at a rate of 1.5% per month, or the maximum rate permitted by law.
Collection Costs
7.6 In the event of non-payment, the client agrees to pay all costs associated with the collection of the outstanding balance, including legal fees and court costs.
7.7 Let’s Explore may modify the payment terms at any time by providing written notice to the client.
